What the law says ?
In the legal sense, an estate sale occurs when heirs wish to sell a property they have inherited. To be eligible for this inheritance, the Civil Code of Quebec stipulates, among other things, that each heir has legal status and is not considered "unworthy to inherit*."
To proceed with the sale, the heirs must first obtain a "declaration of transmission" from a notary, which will serve to formalize the transfer of ownership from the deceased to the heirs.
Warning! The sale of an inherited property is only possible when all heirs agree. If even one of them wishes to keep it, all other legally involved parties will have to agree on a common solution.
